Our Terms & Conditions, together with our Privacy Policy, constitute a legally binding agreement between Branich Motorsports, LLC, dba FF Fatleg’s Vinyl Lettering and Graphics, and you. Please read through the following information.
Restrictions on Age
In order to use this website, place orders from this website, or use any social media outlets, you must be 18 years of age or older.
Legally Binding Agreement
By ordering products or services from our website or social media, you agree to be legally bound by these Terms & Conditions, and by our Privacy Policy. Branich Motorsports, LLC, reserves the right to update these Terms and our Privacy Policy at any time without prior notice. By continuing to access our website or social media accounts, you will be legally bound to these Terms & Conditions and the Privacy Policy.
Payment
- A non-refundable deposit of 50% is required before printing begins.
- All prices are in U.S. dollars.
- Payments accepted are VISA, MasterCard, Discover, American Express, and PayPal.
- Changes to artwork, specifications, or production time are not possible once job is approved.
- Sales tax will be charged in the state of New York, unless the customer has a NYS Resale Certificate and provides a copy of same to Branich Motorsports, LLC.
Shipping & Handling
We are not responsible for delays caused by shipping carriers, weather, or any other situation beyond our control, or for any damages resulting from the failure to receive an order on time. Our responsibility is limited to producing the order and delivering it for shipping. All orders are shipped with insurance and we are not liable for any damages that occur during shipping.
Limited Warranty
We always try to achieve 100% satisfaction of our customers. All sales are final, but if we determine an error was made on our part, we will reproduce your order. We must be notified within 48 hours of delivery of any issues with the product. We may request return of 100% of a defective order within 5 business days before we will reproduce an order. This limited warranty is the sole warranty concerning your products.
Liability of Error
We are in no way liable for errors in a final product due to misspelling, bleeds, grammar, punctuation or size. We are also not responsible for color selection or errors in the artwork production by the customer.
Product Order Quantities
Due to the nature of our manufacturing process, final order quantities will be delivered within 10% of the number of units ordered. We do not guarantee exact quantities will be delivered.
Artwork & Color Matching
Branich Motorsports, LLC, accepts no responsibility for artwork files that are of inferior quality, are of low-resolution, or are not print-ready. Please read our Artwork Requirements on our FAQ page for more information. We will not be held responsible for any orders that have images printed as fuzzy, distorted or pixelated due to customer artwork. All colors for printing are converted to CMYK by default when printing full colors. We try our absolute best to match colors properly to the artwork provided.
We also can color match to Roland Spot Colors. Please contact us if you would like a printed sample of the spot color swatches we use. There is always a chance of slight variations in color reproduction as well as color density produced in the final product.
Quotes & Pricing
All quotes/prices are only valid if they are available for viewing on the StickNoEvil™ website or have been provided in writing via email or postal mail. Any prices provided verbally cannot be verified by StickNoEvil™/Branich Motorsports, LLC.
Governing Law
Branich Motorsports, LLC, is a limited liability company formed under the laws of the state of New York. The internal laws of New York State shall govern the performance of these Terms and Conditions, without regard to that state’s conflict of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in New York State for all disputes arising out of, or relating to, the Terms and Conditions, our website and social media, and our products and services.
Indemnification and Reservation of Rights
You agree to indemnify, defend and hold harmless Branich Motorsports, LLC, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to this website from and against all losses, expenses, damages and costs, including attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or your use and access of the Site. Branich Motorsports, LLC, reserves the right to release current or past member or website user information if Branich Motorsports, LLC, believes a member’s account is being used to commit unlawful acts, if the information is subpoenaed and/or if Branich Motorsports, LLC, deems it necessary and/or appropriate.
Trademarks
Branich Motorsports, LLC, owns the StickNoEvil™ and monkey design trademarks. You may not use, copy or alter any of our trademarks without our prior written consent. Other trademarks and service marks referenced on this website may be the trademarks of their respective owners.
Copyright Notice
Except for materials submitted by you or other persons or entities or taken from the public domain, all text, artwork, graphics and other works of authorship created by or for StickNoEvil™/Branich Motorsports, LLC, and made part of this website, together with the selection, arrangement and presentation of such materials, are protected copyrights of Branich Motorsports, LLC.
All materials we create in producing your printed product are the property of Branich Motorsports, LLC. Although these materials will NOT be sold or given to any other party, we reserve the right to distribute free samples of your printed product.
International Use
You agree not to download or otherwise export any items in violation of United States export controls. Although this website may be accessed worldwide via the World Wide Web, we make no representation that materials accessed through this website are appropriate or lawful outside the United States.
Miscellaneous
This Agreement represents the entire agreement between StickNoEvil™/Branich Motorsports, LLC, and you. If we waive your breach of any provision of this Agreement, we have not waived our rights to pursue your subsequent breach of that provision or any other provision of this Agreement. The determination by a court of competent jurisdiction that any portion of this Agreement is invalid or unenforceable on any ground shall not affect the validity and enforceability of any other portion of this Agreement.
